Terms of Service — Emerald Vision Television Limited

1. Introduction and Acceptance of Terms

These Terms of Service (the “Terms”) govern the provision and use of services offered by Emerald Vision Television Limited (the “Company”, “we”, “us”, or “our”), a television business providing television sales and setup, wall-mounted TV installation, antenna and satellite TV installation, smart TV configuration and streaming setup, TV troubleshooting and diagnostics, and home cinema and sound system setup.

By requesting, booking, purchasing, accessing, or using any of our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

These Terms apply to all customers, whether acting as consumers or businesses, to the extent permitted by applicable law.

2. Scope of Services

Emerald Vision Television Limited may provide the following services, subject to availability, technical feasibility, and any additional service-specific quotation or agreement:

  • Television sales and setup;
  • Wall-mounted TV installation;
  • Antenna and satellite TV installation;
  • Smart TV configuration and streaming setup;
  • TV troubleshooting and diagnostics;
  • Home cinema and sound system setup.

Any estimate, quote, or recommendation is based on the information available at the time and may change if site conditions, equipment compatibility, safety requirements, or customer instructions differ from those initially provided.

We reserve the right to refuse or suspend any service where, in our reasonable opinion, the requested work is unsafe, technically impractical, or likely to breach law, manufacturer guidance, or applicable standards.

3. User Obligations and Responsibilities

You agree to:

  • Provide accurate, complete, and up-to-date information when booking or requesting services;
  • Ensure that any premises where services are to be carried out are safe, accessible, and ready for work at the agreed time;
  • Obtain all necessary permissions, consents, licenses, and approvals required for installation or alteration works, including landlord, management company, or property owner consent where applicable;
  • Disclose any relevant hazards, hidden wiring, structural issues, asbestos concerns, weak walls, water ingress, or other conditions that may affect the service;
  • Ensure that all connected devices, accounts, subscriptions, network credentials, and source equipment are available for setup or testing;
  • Back up any data, settings, or stored content before any diagnostic, installation, reset, or configuration work is performed;
  • Comply with any reasonable instructions provided by our technicians;
  • Use any equipment, installations, or configurations in accordance with manufacturer instructions and applicable law.

You acknowledge that failure to meet these obligations may delay or prevent completion of services and may result in additional charges.

4. Payment Terms and Conditions

Unless otherwise agreed in writing, payment is due in full upon completion of the service, or in advance where a deposit, prepayment, or booking fee is required.

  • Prices may be quoted in advance, but final charges may vary where additional work, materials, parts, access requirements, or call-out time are reasonably necessary.
  • Any quoted price excludes costs not expressly stated as included, such as additional cabling, brackets, fixings, replacement parts, or special-order items, unless specified otherwise.
  • We may require a deposit for ordered goods, custom work, or booked installation appointments.
  • Invoices are payable using the payment methods made available by us from time to time.
  • Late or failed payments may result in suspension of services, withholding of goods, and recovery of reasonable collection costs and interest where permitted by law.

If you dispute any part of an invoice, you must notify us promptly and in any event within a reasonable time after receipt, providing full details of the issue. You must pay any undisputed portion in accordance with these Terms.

5. Cancellation and Refund Policy

You may cancel a booked service by contacting us using the details in Section 12. Cancellations should be made as early as possible.

  • If you cancel after a technician has been dispatched, arrived, or commenced work, we may charge a reasonable cancellation fee and any costs already incurred.
  • If materials, equipment, or custom items have been ordered or allocated specifically for your service, those costs may be non-refundable to the extent permitted by law.
  • Where services have been fully performed, refunds will only be provided where required by law or where we agree that the service was not delivered in accordance with the agreed scope.
  • Any refund due will be processed using the original payment method where reasonably possible, unless otherwise agreed.

Consumer cancellation rights, if any, apply only to the extent required by applicable law. Where services are scheduled to commence within any legally permitted withdrawal period, you may be asked to provide express consent to immediate performance and acknowledgment that you may lose any cancellation right once the service has been fully performed, where allowed by law.

6. Liability Limitations

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded.

Subject to the foregoing, Emerald Vision Television Limited shall not be liable for:

  • Indirect, incidental, special, punitive, or consequential losses;
  • Loss of profit, revenue, business, opportunity, goodwill, or anticipated savings;
  • Loss, corruption, or alteration of data, content, recordings, settings, or software;
  • Damage arising from pre-existing faults, defective equipment, hidden defects, structural issues, or misuse;
  • Service interruptions caused by third parties, broadcasters, internet providers, streaming platforms, signal providers, utility outages, or network failures;
  • Issues caused by customer-supplied equipment, software, accounts, passwords, or accessories;
  • Any delays or non-performance resulting from inaccurate information, failure to provide access, or unsafe premises.

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with any service shall be limited to the amount paid by you for the specific service giving rise to the claim.

We do not guarantee that any specific television, satellite, streaming, network, or home cinema configuration will be compatible with all future software updates, broadcaster changes, platform changes, or device firmware modifications.

7. Intellectual Property Rights

All intellectual property rights in our branding, website content, templates, documentation, reports, images, and materials created by or for Emerald Vision Television Limited remain our property or the property of our licensors, unless otherwise agreed in writing.

You are granted a limited, non-exclusive, non-transferable right to use any documentation or instructions provided to you solely for your personal or internal business use in connection with the relevant service.

You must not copy, reproduce, modify, distribute, sell, or exploit our materials without our prior written consent, except where such use is expressly permitted by law.

8. Data Protection and Privacy

We may collect and process personal data in connection with quotations, bookings, service delivery, billing, customer support, warranty handling, and legal compliance.

We will process personal data in accordance with applicable data protection laws. This may include the use of your name, address, contact details, service history, payment information, and communications with us.

  • We will only process personal data where we have a lawful basis to do so.
  • We may share personal data with payment processors, suppliers, subcontractors, delivery partners, or professional advisers where necessary for service performance, legal compliance, or legitimate business operations.
  • We take reasonable technical and organizational measures to protect personal data, but no system can be guaranteed completely secure.
  • You may have rights in relation to your personal data, including rights of access, correction, deletion, restriction, objection, and portability, subject to applicable law.

9. Force Majeure

Emerald Vision Television Limited shall not be liable for any delay or failure to perform obligations caused by events beyond our reasonable control, including but not limited to acts of God, severe weather, fire, flood, epidemic or pandemic, strike, labour dispute, power outage, internet outage, equipment failure, transport disruption, civil unrest, war, terrorism, governmental action, or supply chain disruption.

Where a force majeure event occurs, we may suspend or modify performance for the duration of the event and shall use reasonable efforts to resume services as soon as practicable.

10. Changes to Terms

We may update or modify these Terms from time to time to reflect changes in our services, business operations, legal requirements, or technical practices.

The revised Terms will take effect when posted or otherwise communicated to you, unless a later effective date is stated. Your continued use of our services after any change constitutes acceptance of the updated Terms.

If a change materially affects an existing booking or contract, we will apply the version of the Terms in effect at the time of booking unless otherwise required by law or agreed in writing.

11. Applicable Law and Jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws applicable in Ireland, subject to any mandatory consumer protection rules that apply by law.

Subject to any mandatory legal rights you may have, the courts of Ireland shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the services provided by Emerald Vision Television Limited.

13. Severability Clause

If any provision of these Terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or if that is not possible, severed from these Terms.

The remaining provisions shall continue in full force and effect.

These Terms constitute the entire agreement between you and Emerald Vision Television Limited concerning the subject matter herein and supersede any prior understandings or communications to the extent permitted by law.
